Ukrainians were told how to get a postponement from mobilization for parental care.
This was reported by the lawyer of the law firm "Riyako&Partners" Kateryna Anishchenko.
The Law of Ukraine provides for the possibility of exemption from conscription during general mobilization for citizens who care for disabled parents of group I or II. This is one of the categories that are granted the right to a postponement.
However, if parents have a group III disability, obtaining a postponement is decided individually. The main factor is a medical conclusion that must confirm the need for constant care of the person with a disability. Simply having a group III disability without a medical conclusion does not provide grounds for a postponement.
"In such situations, a person must be incapacitated, and their health condition must require constant care. If both parents have group III disabilities and there is no one to care for them except the only son, this may become a basis for postponement," the lawyer noted.
To obtain a postponement on the basis of parental care, it is necessary to contact the medical advisory commission (MAC). It is convened at the place of registration in the medical institution where the patient has a declaration with the doctor.
For this, it is necessary to:
- undergo an examination of the health condition of the parents;
- contact the family doctor;
- call a MAC meeting to assess the condition of the parents and confirm the need for constant care.
After receiving the relevant conclusion confirming the need for care, the man can officially submit an application and documents to obtain a postponement from mobilization, indicating the health condition of the parents.
The Ministry of Defense of Ukraine has started testing online postponements from mobilization in Reserve+.
