In Ukraine, fines will be calculated differently — what to expect.


Members of Parliament in the Verkhovna Rada will be proposed to change the approaches to the formation of fines and administrative fees in Ukraine. Currently, it all depends on the size of the subsistence minimum, but new indicators may appear from 2026.
The relevant innovations are described in the draft law 'On Amendments to Certain Legislative Acts of Ukraine Regarding Regulation of Issues of Formation of the Subsistence Minimum and Creating Prerequisites for Its Increase'.
How fines are expected to be determined in Ukraine
It is anticipated that the systemic approaches to determining monetary obligations in the form of fines and fees will change. A new principle will emerge, where the subsistence minimum will no longer be the basis for calculating fines and administrative fees starting from January 1, 2026.

- administrative fee rate for determining the sizes of the administrative fee.
It is expected that the amount of the rates will not exceed 2,028 hryvnias. It is explained that the subsistence minimum is used to determine the sizes of fines, fees, and other payments, which causes contradictions.
'The subsistence minimum, defined by law as the basic social standard, artificially plays the role of a conditional calculation unit. This leads to the loss of its primary social purpose, the impossibility of economic and social support for citizens, and, as a result, a decrease in trust in state social guarantees', the document states.
The proposed law aims to clearly separate the social function of the subsistence minimum from its financial and technical application.
What else is worth knowing
Starting from August 1, fines for entrepreneurs in Ukraine who do not issue receipts or do not use PPO will be applied in full. Additionally, due to debts, Ukrainians face property seizure. The Central Interregional Administration of the Ministry of Justice explained what items will not be seized from a debtor under any circumstances.
Ukrainian members of Parliament are considering the possibility of changes in the system of fines and administrative fees imposed on citizens. In particular, the exclusion of the subsistence minimum from the basic indicators for determining the size of penalties is being discussed. This could lead to an improvement in the system of determining fines and avoiding contradictions related to the use of the subsistence minimum for these purposes. The reform aims to clearly separate the social function of the subsistence minimum from its financial and technical use.
